The terms for a Competitive Response Brief, in plain English.
Effective September 6, 2026. The seller is Michelle Perkins, sole proprietor, trading as Competitor Launch, 12 Harbor Street, East Hampton, NY 11937. By confirming scope and paying for a brief you agree to these terms.
What is provided
A Competitive Response Brief covers one competitor, one buyer brand, one agreed market, and one agreed observation window. It includes up to 50 verified ad records, detailed analysis of up to 10 distinct creative concepts, up to two competitor landing pages, a comparison with your brand, three prioritized test briefs with a 14-day sequencing recommendation, and a source index. It is delivered as a PDF and an editable PowerPoint file of approximately 12 to 15 decision slides plus references.
The service is Meta-first. Google advertising evidence is included only when usable coverage is confirmed before payment.
Not included are creative production, campaign management, proprietary competitor performance data, additional competitors, and ongoing research. Healthcare, pharmaceutical, therapeutic, and supplement products are not covered.
Scope, then payment
Before any payment, I check the available evidence and confirm in writing the coverage, outputs, kickoff, and exact delivery date. You then receive a payment link. The fee is $1,500, paid in full before work starts. If the pre-payment check shows insufficient evidence for a useful brief, I will say so and no payment is requested.
The agreed observation window is fixed at confirmation. Ads that appear after that point are not added to the brief.
Delivery and guarantee
The brief is delivered within two business days of the confirmed kickoff, on the exact date confirmed before payment. Business days are Monday through Friday, U.S. Eastern time, excluding U.S. federal holidays.
The guarantee is this. The agreed brief, by the confirmed deadline, or you may request a full refund. Refund requests are made by email within seven calendar days of the confirmed deadline and are returned to the original payment method.
Factual errors in a delivered brief are corrected without charge.
Clarification round
One consolidated round of clarification questions is included when submitted by email within seven calendar days of delivery. Further questions, new competitors, or new observation windows are a new engagement.
License to the brief
You receive a perpetual, non-exclusive license to use the brief, the analysis, and the test briefs internally and with the agencies and service providers who work on your brand. The brief may not be resold, republished, or presented as your own or a third party's research.
No license to third-party creative is granted or implied. Competitor advertising, trademarks, and landing-page material reproduced in the brief remain the property of their rights holders and are included only for commentary and analysis. You may not reuse them in your own advertising on the basis of the brief.
No performance guarantees
The brief is independent commentary on publicly observable advertising and my professional recommendation on what to test. It does not assert competitor performance, spend, targeting, or commercial results unless an identified source supports the statement. No revenue, return on ad spend, conversion, or ranking outcome is promised. Decisions made using the brief are yours.
Confidentiality and conflicts
Public observations are non-exclusive and may inform other work. Your private inputs and the buyer-specific recommendations in your brief are kept confidential. Where a proposed engagement would conflict with an existing client, I disclose the conflict, without revealing any client's confidential information, before accepting work.
Liability
Total liability for any claim connected with a brief is limited to the fee paid for that brief. Nothing in these terms limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute is brought in the state or federal courts located in Suffolk County, New York.
